If a brand, studio, team, or development group includes members under 18, the official seller account holder, contracting party, payout recipient, and responsible representative must still be at least 18 years old.

KW Studio may request confirmation of age, legal capacity, payout eligibility, account authority, or seller authority where needed for seller verification, payment safety, legal compliance, or marketplace trust.

If KW Studio discovers that a seller account is controlled by a person under 18, KW Studio may restrict, suspend, remove, or transfer seller access where appropriate and lawful.

Sellers should review the privacy policies and terms of Payhip, PayPal, Stripe, Roblox, Discord, and any other services they choose to connect, reference, or link through their public seller profile.

KW Studio is not responsible for the independent privacy practices of third-party websites or platforms.

20. Cookies, Analytics, and Seller Dashboard Technologies

KW Studio and the seller dashboard may use cookies, scripts, local storage, analytics tools, security tools, and similar technologies for seller dashboard login, session management, security, fraud prevention, dashboard performance, account access, support tools, and marketplace analytics.

Some cookies or similar technologies may be essential for dashboard login and security. Optional analytics or marketing cookies may require consent where applicable.

Cookie information for the main KW Studio website is available at:

https://kwstudio.org/cookie-policy

Where the seller dashboard uses separate cookies, analytics, security tools, or dashboard-specific technologies, additional dashboard notices or provider terms may apply.

21. International Data Transfers

Seller data may be processed or stored in countries outside the seller’s own country, including outside the European Economic Area, depending on the services used for hosting, payment processing, analytics, security, email, support, or marketplace infrastructure.

Where required, KW Studio or its providers may rely on appropriate safeguards for international transfers, such as adequacy decisions, Standard Contractual Clauses, contractual protections, service provider terms, or other legally recognized mechanisms.

22. Data Retention

KW Studio keeps seller data only for as long as reasonably necessary for the purposes described in this policy, unless a longer retention period is required or permitted by law.

Retention periods may depend on:

  1. Whether the seller account is active.
  2. Whether the seller has listed products.
  3. Whether buyers still need access to purchased products.
  4. Whether the seller has open support cases.
  5. Whether there are disputes, reports, ownership claims, unsafe-file reports, or legal issues.
  6. Whether accounting, tax, payment, fraud prevention, or legal recordkeeping obligations apply.
  7. Whether the data is needed to protect marketplace integrity.
  8. Whether the data is needed to prevent repeat abuse or ban evasion.
  9. Whether applicable marketplace, consumer protection, trader traceability, tax, or seller reporting rules require retention.

22.1 Seller Account Data

Seller account data may be retained while the seller account exists and for a reasonable period afterward.

If a seller account is rejected, closed, suspended, or terminated, certain records may be retained where needed for fraud prevention, seller review history, legal claims, repeat abuse prevention, marketplace safety, or compliance.

22.2 Public Seller Profile Data

Public seller profile data may remain visible while seller products remain published, while the seller account remains active, or while buyer access and product support remain relevant.

If a seller is removed, suspended, or terminated, some public information may be removed, restricted, or retained internally depending on the circumstances.

22.3 Product, Order, and Buyer Access Records

Product, order, payout, refund, chargeback, delivery, support, and buyer access records may be retained where needed to support past buyers, maintain purchase records, preserve product access, handle refunds, resolve disputes, comply with accounting or tax obligations, support seller reporting, and defend legal claims.

22.4 Seller Verification, KYB, and Trader Traceability Records

Seller verification, KYB, business status, trader status, freelancer status, ownership proof, and traceability records may be retained for as long as necessary to comply with legal obligations, operate the marketplace, verify seller legitimacy, protect buyers, handle disputes, prevent fraud, defend legal claims, and comply with marketplace safety requirements.

Where specific marketplace trader traceability rules apply, certain trader traceability information may be stored securely for the legally required period after the end of the contractual relationship with the seller, unless a longer retention period is required or permitted for tax, accounting, legal claims, fraud prevention, payment disputes, or other lawful purposes.

22.5 Legal, Report, and Moderation Records

DMCA notices, copyright claims, product reports, unsafe-file reports, ownership disputes, moderation records, enforcement decisions, seller warnings, and legal communications may be retained for as long as necessary to resolve the issue, prevent repeated abuse, document marketplace decisions, preserve evidence, defend legal claims, or comply with legal obligations.

22.6 Cookie Consent and Analytics Data

Cookie consent records, analytics records, dashboard session information, and technical logs may be retained according to the settings of the relevant analytics, cookie, security, or consent provider and applicable law.

23. Seller Data Rights

Depending on your location and applicable law, you may have rights regarding your personal data, including the right to:

  1. Request access to your personal data.
  2. Request correction of inaccurate personal data.
  3. Request deletion of certain personal data.
  4. Request restriction of processing.
  5. Object to certain processing.
  6. Request data portability where applicable.
  7. Withdraw consent where processing is based on consent.
  8. Lodge a complaint with a data protection authority.

These rights are not absolute.

KW Studio may need to retain certain information for legal obligations, accounting records, tax records, fraud prevention, dispute handling, product access, marketplace integrity, legal claims, buyer protection, seller enforcement, seller verification, payment processor requirements, or compliance with marketplace rules.

To make a privacy request, contact:

legal@kwstudio.org

KW Studio may need to verify your identity before responding to a privacy request.

KW Studio will respond to valid privacy requests within the timeframe required by applicable law.

24. Finnish Data Protection Authority

If you are located in Finland or the European Union and believe your data protection rights have been violated, you may have the right to lodge a complaint with your local data protection authority.

In Finland, the supervisory authority is the Office of the Data Protection Ombudsman.

You may also contact KW Studio first at:

legal@kwstudio.org

25. Account Deletion and Seller Removal

Sellers may request account deletion or removal from the marketplace by contacting KW Studio.

However, account deletion may not immediately delete all related data.

KW Studio may retain certain seller records where needed to:

  1. Keep buyer access records.
  2. Handle refunds, chargebacks, or disputes.
  3. Preserve legal, copyright, DMCA, or unsafe-file records.
  4. Maintain accounting and tax records.
  5. Support platform reporting obligations where applicable.
  6. Investigate fraud, abuse, or marketplace rule violations.
  7. Enforce marketplace terms.
  8. Protect buyers, sellers, rights holders, and marketplace integrity.
  9. Prevent ban evasion or repeat abuse.
  10. Comply with legal, payment, or marketplace obligations.

If seller products have been sold, downloaded, reported, reviewed, or involved in support cases, KW Studio may need to preserve some product, order, licence, support, moderation, or dispute records even after seller account closure.

26. Data Security

KW Studio uses reasonable technical and organizational measures to protect seller data.

These may include:

  1. Access controls.
  2. Account review.
  3. Dashboard restrictions.
  4. Logging.
  5. Security checks.
  6. Seller verification.
  7. Manual product review.
  8. Abuse detection.
  9. Limiting access to seller data to people who need it for marketplace operations.
  10. Support and legal escalation procedures.

No online service can guarantee perfect security.

Sellers are responsible for keeping their dashboard login credentials, email accounts, Payhip accounts, payment accounts, Roblox accounts, Discord accounts, and other connected accounts secure.

Sellers should notify KW Studio immediately if they suspect unauthorized access, account compromise, leaked credentials, or misuse of seller data.

27. Data Breach Handling

If KW Studio becomes aware of a personal data breach affecting seller data, KW Studio may investigate the issue, take steps to limit harm, preserve relevant records, contact affected service providers, and notify affected sellers or authorities where required by applicable law.

Sellers should contact KW Studio at legal@kwstudio.org if they believe seller data, buyer data, account data, payout data, product proof, support data, or dashboard data has been exposed, misused, accessed without authorization, or sent to the wrong party.

28. Automated Tools and Human Review

KW Studio may use automated or semi-automated tools to help detect spam, fraud, bot traffic, suspicious seller applications, duplicate submissions, unsafe files, suspicious orders, suspicious login activity, chargeback risk, scraping, ban evasion, or marketplace misuse.

KW Studio does not intend to make solely automated decisions that produce legal effects or similarly significant effects without appropriate human review where required by law.

Seller approvals, seller rejections, product moderation, product removals, payout-related restrictions, refund reviews, legal report reviews, ownership disputes, and seller enforcement decisions may involve human review.

29. Children and Seller Accounts

KW Studio seller accounts are intended only for sellers who are at least 18 years old.

If KW Studio discovers that a seller account is controlled by a person under 18, KW Studio may restrict, suspend, or remove seller access, request an adult responsible representative, or take other action where appropriate.

30. Seller Responsibility for Third-Party Personal Data

Sellers must not upload or submit unnecessary personal data about other people through product files, screenshots, support messages, product descriptions, ownership proof, profile fields, documentation, product media, or product files.

If a seller submits third-party personal data, the seller must ensure they have a lawful basis or permission to do so.

Sellers are responsible for ensuring their uploaded products, product files, product descriptions, support messages, profile fields, ownership materials, and public links do not violate privacy rights, copyright rights, platform rules, or applicable laws.

31. Buyer Data and Seller Responsibilities

Sellers may receive limited buyer, order, or contact information through Payhip, product support, KW Studio communication, marketplace tools, or seller contact routes.

Sellers may use buyer data only for:

  1. Order fulfillment.
  2. Product support.
  3. Legal compliance.
  4. Resolving product-specific issues.
  5. Marketplace-related communication.
  6. Responding to KW Studio moderation, refund, or legal requests.

Sellers must not:

  1. Sell buyer data.
  2. Share buyer data publicly.
  3. Use buyer data for unrelated marketing.
  4. Add buyers to mailing lists without valid consent.
  5. Harass buyers.
  6. Contact buyers for unrelated promotions.
  7. Scrape buyer information.
  8. Use buyer information outside the marketplace relationship.
  9. Request unnecessary personal data from buyers.
  10. Ask buyers for Roblox passwords, payment card numbers, private keys, or unrelated sensitive information.
  11. Move buyer support into unsafe or misleading channels.
  12. Store buyer data insecurely.
  13. Keep buyer data longer than necessary for the lawful purpose.

Sellers must promptly notify KW Studio if they suspect buyer data has been lost, exposed, misused, breached, accessed without authorization, or sent to the wrong party.

Depending on how a seller processes buyer or support data, the seller may have independent data protection responsibilities.

32. Product Files and Hidden Personal Data

Sellers are responsible for ensuring that product files do not contain hidden personal data, private credentials, API keys, private links, internal notes, buyer data, confidential information, or unauthorized third-party personal data.

This includes checking:

  1. Roblox Studio files.
  2. Scripts.
  3. Module scripts.
  4. Configuration files.
  5. Documentation.
  6. Screenshots.
  7. Videos.
  8. Images.
  9. ZIP files.
  10. External links.
  11. Setup files.
  12. Third-party dependency references.

KW Studio may review product files or request proof where necessary, but sellers remain responsible for cleaning and checking their files before submission.

33. Marketing and Seller Communication

KW Studio may contact sellers about:

  1. Seller applications.
  2. Dashboard access.
  3. Product submissions.
  4. Product review.
  5. Product moderation.
  6. Ownership proof.
  7. Payout setup.
  8. Refunds or chargebacks.

  10. Legal reports.
  11. Seller policy updates.
  12. Marketplace changes.
  13. Seller opportunities.
  14. Optional promotions, campaigns, boosts, or business opportunities.

Sellers may opt out of optional marketing communications where applicable.

Service-related, legal, security, dashboard, product, refund, moderation, and seller account communications may still be sent where necessary.

34. No Sale of Seller Personal Data

KW Studio does not sell seller personal data to advertisers.

KW Studio may use third-party tools for seller dashboard operation, payment processing, analytics, cookie consent, hosting, support, security, email, legal review, moderation, or marketplace operations. Those tools may process seller data according to their own terms, privacy policies, and data processing roles.

35. Seller Privacy Requests

Seller privacy requests can be sent to:

legal@kwstudio.org

A seller privacy request should include:

  1. Your full name.
  2. Your seller store name.
  3. Your contact email.
  4. The type of privacy request.
  5. The information or account the request relates to.
  6. Any seller dashboard ID, ticket reference, product URL, order reference, payout reference, or report reference if relevant.
  7. Enough information for KW Studio to verify the request.

Do not include passwords, payment card numbers, private keys, or unnecessary sensitive information in a privacy request.

KW Studio may refuse, limit, or delay a request where allowed by law, including where identity cannot be verified, the request is manifestly unfounded or excessive, or the requested data must be retained for legal, accounting, fraud prevention, marketplace safety, dispute, seller verification, product access, buyer protection, tax reporting, payment, or legal claim purposes.

36. Changes to This Seller Privacy Policy

KW Studio may update this Seller Privacy Policy when the dashboard, marketplace structure, seller tools, legal requirements, payment flows, moderation processes, seller verification, KYB requirements, trader status requirements, tax reporting, platform reporting, cookie tools, analytics tools, or data practices change.

The updated version will be posted on the relevant KW Studio website or dashboard page with a new “Last Updated” date.

Continued use of the seller dashboard or seller features after changes may mean that you acknowledge the updated policy where applicable.

Where required by law, KW Studio may provide additional notice or request consent for certain changes.
